Our Privacy Policy

Our Privacy Policy is simple:
At no time will we ever give your name, email address, or other personal information to any third party without asking you first.

Periodically, we will send email to all of our clients. This email is automatically sent to everyone with an email account hosted on our servers. Consequently, it is not possible to opt in or out of these emails.

Domain Name Registration Policies

Domain names requested are not registered until a confirmation is received from the registrar.  Registered domain names remain the property of VisionBurst, Inc. until full payment is received.

Client assumes full responsibility for any trademark infringements resulting from domain name(s) registered by VisionBurst on Client's behalf.

It is the Client's responsibility to pay the renewal fee prior to the end of the registration year.  VisionBurst, Inc. assumes no responsibility for disruption of service due to expiration of Client's domain name.

Site Design Policies

All web site design work is performed according to the terms of a written Web Site Design Agreement, signed by the Client and a VisionBurst, Inc. representative.

Internet Marketing Policies

VisionBurst does not guarantee listings on search engines, as the search engines alone determine whom they will list and where they will be listed.

Unless otherwise noted in writing, any placement fees charged by the search engines to complete submission or improve placement are not included in the marketing fee, and shall be payable by Client only if paid placement services are specifically requested by Client. 

In the web design process, VisionBurst prepares the site for search engine submission, which includes analysis of text for keyword content, alt tags for images, preparation and installation of keyword and content meta tags, and submission to major search engines.

Web Site Hosting Policies

Web hosting accounts are for the purposes of hosting websites and email ONLY. Any account found running a game server, an IRC server, or an IRC bot, will be terminated immediately. Any fees paid will be forfeited.

The person that signs up for an account is the person responsible for it. If you no longer wish to be responsible for payment contact VisionBurst, Inc. immediately. Accounts are NOT transferable without specific permission from VisionBurst, Inc..

Any account which consistently exceeds its disk quota will be asked to upgrade to the next level package. Similarly, accounts which place a great level of stress on a machine through excessive CPU usage will be asked to upgrade to a higher level package. We reserve the right to kill any process which uses considerable amounts of CPU time and RAM. Refusal to upgrade or to bring system usage within account parameters may result in the termination of the offending account.

Accounts cannot be used for any of the following purposes: Spamming or sending UCE (unsolicited commercial email), software piracy, distribution of pornographic material (except on separate servers), hacking, or attempting to use machine or network resources for unlawful purposes. Any account violating these rules will be terminated immediately and no refunds will be issued. Accounts used for spam will be charged $100 per complaint received plus any expenses incurred in cleaning up after the spam.

For new clients only, accounts cancelled within the first four weeks of service will receive a full refund less any set-up fees. Accounts voluntarily cancelled after that period or additional accounts set up by existing clients will receive a refund only for FULL months or quarters (depending on the type of account) remaining that have been pre-paid. Under no circumstances will the set-up fee be refunded. Refunds will be made in the same form as the original payment. You must explicitly notify us via EMAIL from your web hosting account (phone requests will not be accepted without credit card verification for your own protection) if you wish to cancel your account. Accounts are still considered active and will be charged even if you do not log in and use them. Your billing period starts the day your account is activated, whether or not you are actively publicizing a site.

Reactivation of a suspended account will incur a $10 reactivation fee.

General system support is available free of charge by telephone or email. Support for Advanced UNIX topics, and HTML, when available, will incur a charge of $65 and $50 per hour, respectively.

If you do not see a utility or program on our servers that you require, please inquire about it. We can obtain and install nearly any utility that you may need. However, there may be circumstances where we cannot fulfill every request or where we must charge a fee for the service.

Services are provided on an 'as is' basis. VisionBurst, Inc. cannot and will not be held liable for any damages that may occur, whether indirect, incidental, or consequential that may arise out of use of VisionBurst, Inc.' services. Please remember to always keep a local backup copy of your work on your own personal computer.

Refund Policies

All transactions are processed according to the terms of a written contract or in keeping with the policies on this page.

Refunds are only available if VisionBurst, Inc. fails to comply with terms of a signed contract or with policies listed on this page at the time of the transaction.

General Policies

If it becomes necessary for VisionBurst to bring legal action to collect any sums due under this Agreement, VisionBurst shall be entitled to collect, in addition to all damages, its costs of collection, including reasonable attorney's fees.

Client shall indemnify, defend, and hold harmless VisionBurst from and against any and all lawsuits, claims, actions and liabilities, of any nature, arising in any manner from, relative to, or in conjunction with the Web Site designed, hosted, maintained, and/or marketed under this Agreement, including but not limited to the use of trademarks or other intellectual property supplied by Client for inclusion in the Web Site or its domain name.

VisionBurst SHALL IN NO EVENT BE LIABLE TO CLIENT FOR ANY DAMAGES OR LOSSES, INCLUDING WITHOUT LIMITATION DIRECT, INDIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL OR PUNITIVE DAMAGES RESULTING FROM OR RELATING TO VisionBurst'S OBLIGATIONS PURSUANT TO THIS AGREEMENT, INCLUDING WITHOUT LIMITATION THOSE ARISING FROM OR RELATING TO ANY FAILURE IN THE WEB SITE, DELAYS IN OPERATION OR TRANSMISSION, DELAYS IN UPDATING, MODIFYING OR AMENDING THE WEB SITE, COMMUNICATIONS LINES FAILURE, OR ANY ERRORS OR OMISSIONS IN THE FORM OR CONTENT OF THE WEB SITE.

VisionBurst, Inc. will not be held responsible for any content on its client's sites which others may find offensive.

A bounced check will incur a $25 service charge, and all future payments must be made by credit card or money order.

You are responsible for keeping VisionBurst, Inc. informed of any changes to your name, mailing address, phone number, or email address.

VisionBurst, Inc. reserves the right to alter, amend, or change these policies at any time. All accounts are required to comply with any changes made to these policies while their accounts are active. Notification of any major changes to the policies will be emailed to all accounts.
